1. USER CONSENT AND DISCLAIMERS
  • USER CONSENT : The User hereby consents to the collection, use, and disclosure of his Personal Data and Non-personal Data as required by the Site in accordance with this Data Privacy Policy document by creating a User account and thereby agreeing to Ayudh Creations Terms and Conditions of Use, of which this Data Privacy Policy document is a part.
  • TYPES OF DATA :- The two different forms of user data that can be found in a user's content are referred to as "Personal Data" and "Non-personal Data," respectively. Personal Data is any information that can be used to directly identify or get in touch with a particular user.
  • MINIMUM AGE REQUIREMENT :- Anyone under the age of 13 is explicitly prohibited from using the Site, its services, and its contents. If the Site does collect, use, or disclose any Personal Data (and/or Non-personal Data) about anyone under the age of 13, it is not doing so on purpose.
    The Indian Union has an age restriction of 18. As a result, if this jurisdiction applies to you, Ayudh Creations won't intentionally gather, keep, or utilise personal data from minors under the age of 18.
  • DATA PERMISSION :- By uploading any User Content, including Personal Data and Non-personal Data, to the Site, the User hereby represents and warrants that he has the power and authority to (and is further willing to): post the User Content on the Site; share the User Content with other (relevant) Users; and, where appropriate, transfer the ownership of the User Content to another User through the use of an Image Transfer Agreement, as is the case with Images. Unless the User Content that in any way belongs to a third party is being used by an Artist within his portfolio, in which case this is not permitted under any circumstances, regardless of whether the Artist has complied with the first paragraph of provision 1.4. of this Data Privacy Policy document (above), the User must strictly comply with the provision 1.4. first paragraph of this Data Privacy Policy document. The user who uploaded any loss resulting from a third party's use of user content in any way will be entirely and completely responsible for that loss.
  • DATA STORAGE :- Although Ayudh Creations will use reasonable care to protect the contents of the Site, including its Personal Data and Non-personal Data, Ayudh Creations cannot guarantee their absolute security and Ayudh Creations is not responsible for any loss of Personal Data and/or Non-personal Data or any loss in whatsoever form arising to any party(s) as a result of the loss of Personal Data and/or Non-personal Data. The User should be aware that it is entirely his/her responsibility to make backup copies of his or her own Content, including any Images. Ayudh Creations is under no obligation to backup any User Content, including Personal Data and Non-personal Data, and User Content may be deleted and/or lost at any time. After a job is completed, the collaboration page, together with all of its files, messages, marks, and photographs, are erased. Through his User account, the Client will have access to the high-resolution photographs, but only for the allotted amount of time that Ayudh Creations deems fair. The final high-resolution photographs must be collected and backed up on his own; this is the User's whole and only duty.
  • DATA MAINTENANCE :- All Users are entirely and solely responsible for all of their User Content, including all Personal Data and Non-Personal Data; it is the User's duty to ensure that all of their User Content, including all Personal Data and Non-Personal Data, is accurate, complete, reliable, useful, appropriate, true, and integral.
  • DATA DELETION :- Users may delete their User Content, including Personal Data and Non-personal Data, but should be aware that Ayudh Creations may keep some or all of the User Content present in a User's account and not delete it until a later stage (if ever), when all potential requirements linked to that User Content have been satisfied (for instance, with regards to the provision of services, for fraud prevention, to comply with any legal obligations, to resolve disputes, to help enforce agreements, etc.). Any User Content that Ayudh Creations deletes, including User Content that contains Personal Data and/or Non-personal Data, may still exist in Ayudh Creations archives, but it is not intended to serve as a backup and is not accessible to any User, not even the User who originally created the archived User Content. Only when a user’s account is inactive may they remove their user account and all of their User Content, including Personal Data and Non-personal Data, through their user account, by email, or by phoning the Site. Paragraphs one and two of clause 1.7 of this Data Privacy Policy document shall continue to be applicable after a User's account has been deleted by the User.
  • GENERAL DISCLAIMERS :- All clauses in Section 5 of the Terms and Conditions of Use document (on responsibility and disclaimers) apply, where applicable, to all the Supporting Documentation, including this Data Privacy Policy document.
  • ACCESS :- We are willing to provide you reasonable access to your personal information at your request so that you can check what we have on file and, if necessary, ask for changes to be made. You can ask for access by writing to us at the aforementioned email address. We shall respond to your request for access to personal information as soon as is reasonably reasonable, but usually within thirty days. Please provide us a detailed description of the specific information you feel needs to be updated if you want to make changes to your personal information. We will explain why you won't be able to view certain information or why it cannot be changed.

    Ayudh Creations primarily stores, gathers, and otherwise processes information in Mumbai, INDIA.
    If you are residing in INDIA, you have the right to:
    • Access your personal information, have it corrected, have its processing restricted or objected to, or have it deleted
    • To get the private information you gave Ayudh Creations or to send it to another business. More specifically, in accordance with Indian judicial laws, you may ask for and receive copies of the personal information you have provided to us in a structured, generally accepted, and machine-readable format, as well as ask us to transmit this information to another service provider (where technically possible).
    • To revoke any granted consent
    • To choose not to have part of your personal information collected or used, such as through the use of cookies and similar technologies, for marketing reasons, or for data analysis
    • If appropriate, to file a grievance with your supervisory authority.

2. PERSONAL DATA
  • COLLECTION OF PERSONAL DATA :-
    The term "Personal Data" refers to any information that can be used to locate or identify a specific User. For the purposes of the Site, Personal Data is most likely to include a User's avatar, ID, name, surname, address, email, telephone number, bank information, credit card information, dates of birth, and official identification documents. This information is primarily gathered when the User creates his User account. Data on the User's visit to the Site (including browser type, operating system, Internet protocol address, domain name, location, language, time spent on the Site, date and time stamp of visit, etc.), which may be used by the Site to administer the Site, analyse User trends, track User movements around the Site, gather demographic information on Users, etc.; and data on the User's performance (including sales and conversions data, Image price, etc.). In order to safeguard the Site from fraudulent and/or improper action on behalf of any User, Ayudh Creations retains the right to link such automatically gathered data to a User's Personal Data. Users should visit the following website for information on the data collected by Google Analytics: http://www.google.com/intl/en/policies/ for further information on how the Site collects data on Users, including the collection of cookies and user IDs. We won't upload any information that enables Google to identify a specific person individually (such as name, Social Security Number, email address, or any other similar data), or information that identifies a certain device permanently (such as a unique device identifier if such an identification cannot be changed).
  • USE OF PERSONAL DATA :-
    Personal Data is, in general, used by Ayudh Creations to allow and subsequently improve the User’s and/or other Users’ experience with the Site. For example, Ayudh Creations may use Personal Data to: allow the creation of a single, secure User account which will allow the User access to the Site and its services; identify a User’s movements and interactions within the Site; inform internal research and development that could improve the Site and its services; customise the Site to match a User’s preferences; respond to a User’s request; send administrative notifications and promotional materials to Users; block Site access to suspended Users; marketing and surveys; sending service update notices; enabling sales and other transactions; processing payments and settlement; sending payouts; handling orders; providing receipts; providing customer service; providing dispute resolution, chargebacks, refunds, or related issues; recovering debt and collections; detecting and preventing fraud; detecting and preventing violations of our legal agreements; measuring, improving, and customizing our services; fulfilling other technical, financial, legal, compliance, administrative, or back-office functions.
  • DISCLOSURE OF PERSONAL DATA :-
    It is rare that other Users would have access to Personal Data. The more private information contained in a User's Personal Data, such as the User's name, last name, address, email, telephone number, bank information, and/or credit card information, is only available to the User himself and Ayudh Creations.

    Ayudh Creations may have to disclose some or all of a User’s Personal Data to third-party service providers so that Ayudh Creations may, with the assistance of these third-party service providers, deliver the Site’s services to the User. These third-party service providers are required to use a User’s Personal Data solely to provide the services requested by Ayudh Creations; any Personal Data in the possession of a third-party service provider will be subject to that third-party service provider’s own data privacy policy, and not Ayudh Creations Data Privacy Policy document. 2Checkout (2CO), the third-party professional payment platform currently used by the Site, collects and stores its own Personal Data through the Site. The Site’s programmer will also have access to the Site for the purpose of maintenance, revisions, updates, etc. Other disclosures of Personal Data may occur where Ayudh Creations believes, in good faith, that such disclosure is necessary, for example: in conjunction with any disputes, investigations and/or legal proceedings; in compliance with any relevant laws and regulations; in defense of Ayudh Creations or any other Users’ rights and property; etc.

  • STORAGE OF PERSONAL DATA :-
    The Site uses password hashing to protect a user’s account, and it is entirely and solely the User's responsibility to keep said password safe and unknown to other Users and/or unauthorised persons. Credit card information is stored off-Site by a third-party professional payment platform. Ayudh Creations is committed to protecting the security of the Site's contents, including a User's Personal Data.
  • MODIFYING PERSONAL DATA :-
    Any User with a user account can edit their User Content, including Personal Data. Ayudh Creations must again authorise the User before granting access to the Site and its services if the User makes any changes to their Personal Data. When a User desires to completely erase all of his User Content by terminating his user account, the whole provisions of this Data Privacy Policy document shall apply, including paragraph 1.7.
  • TESTIMONIALS AND FEEDBACK :-
    The Site enables all Users to submit feedback, testimonials, and/or endorsements; any feedback is only seen by Ayudh Creations; testimonials and endorsements may be displayed on the Site along with the User's name; however, if the User wishes to remain anonymous, the User's avatar will be used instead. All comments, recommendations, and testimonials are the property of Ayudh Creations after submission, but the author (User) may change, amend, or delete them by contacting Ayudh Creations by phone or email.
  • THIRD PARTIES, LINKED SITES, AND ADVERTISEMENTS :-
    When a User clicks on a link from the Site or clicks on an advertising thereon, or when the User otherwise departs the Site, the User may wind up on another site or in communication with a third party other than Ayudh Creations, who may choose to gather its own data from the User, including Personal Data. The User is then subject to that Site's and/or entity's own data privacy policy (whether or not that Site and/or entity has one), which Ayudh Creations has in no way vetted or approved, and for which Ayudh Creations has no responsibility. The Ayudh Creations Data Privacy Policy document will cease to apply the moment the User navigates away from the Site, including those instances where the User leaves the Site by following any link found on the Site and/or any.
3. NON-PERSONAL DATA
  • NON-PERSONAL USER DATA :-
    The User must provide Non-personal Data in order to fully use the Site and its services. Some examples include any job specifics required by the Site's task form, any comprehensive project files, any material provided on the collaboration page, etc. Non-personal Data supplied by a User in the task form on the site is deemed to be of low sensitivity and will be put on the task board; the task board will only be viewable to Ayudh Creations and not to any other Users.

    Non-personal data, such as detailed project files, are handled with greater sensitivity and will only be posted on the collaboration page; any User Content posted there, including any communications between the User and Ayudh Creations, is only visible to them.
  • DATA OWNERSHIP :-
    However, the User hereby agrees that any images present within the Ayudh Creations portfolio and may be used by Ayudh Creations, at Ayudh Creations full and sole discretion, are owned by the User. All User Content, including both Personal Data and Non-personal Data, as posted by a User belongs fully and exclusively to that User, including any intellectual property rights associated with that User Content and all potential liabilities and/or responsibilities that come with such ownership of that User Content. The only transfer of intellectual property rights permitted on the Site happens through the Image Transfer Agreement document, where the intellectual property rights of those Images marked as finished by the User on the relevant collaboration page are transferred from the Ayudh Creations, who created said Images, to the User, who commissioned said Images, as demonstrated in the relevant User/Ayudh Creations Agreement; while still allowing for the use of said Images by the Ayudh Creationa.
  • STORAGE OF NON-PERSONAL DATA :-
    The Site uses password hashing to secure a user’s account, and it is entirely and solely the User's responsibility to keep said password safe and unknown to other Users and/or unauthorised people. Ayudh Creations is dedicated to preserving the security of the Site's contents, including a User's Non-Personal Data.

    The collaboration page, along with all of its files, messages, markings, and photographs, are erased when a job is completed. The client will have access to the high-resolution photographs through his user account, but only for a limited duration that will be determined solely by Ayudh Creations to be reasonable. The final high-resolution photographs must be gathered and turned into backups, and that is entirely and only the User's duty.

4. COOKIES AND RELATED TECHNOLOGY

Cookies, web beacons (also known as clear gifs), and similar technologies may be used on this site's pages or in email messages when they become available. Cookies are data files that this website may download and store on your computer to offer more functionality. The Ayudh Creations may use cookies for a variety of objectives, including monitoring site usage trends, gauging the impact of advertising, preventing repeated registrations and answers, enhancing site navigation, and as part of verification or screening procedures. Most browsers have cookies enabled by default. The majority of browsers provide you the choice of deleting cookies from your computer's hard drive, disabling cookie acceptance, or getting a warning before a cookie is saved. Ayudh Creations reserves the right to update this privacy statement at any time by posting a notice on this website to inform users of the changes. It is strongly advised that you frequently visit this page and refer to the date of the most recent update at the bottom. The User must stop using this Site and may ask that Ayudh Creations delete the Personal Data if the User opposes to any modifications to the Policy. Unless otherwise specified, any Personal Data that Ayudh Creations possesses about Users is subject to the then-current privacy policy.

6. NONDISCLOSURE AGREEMENT (NDA) FOR Ayudh Creations® CLIENT

To secure the sensitive data of our clients, we offer to sign an NDA (non-disclosure agreement) with Ayudh Creations. In order to sign an NDA with us, you need to apply to your client manager. What are the benefits of signing an NDA with Ayudh Creations and what does it guarantee?

Ayudh Creations respects your professional artwork as well as other intellectual property shared with us and will only use it to assist you with your goals. Your copyrights will remain yours.

Ayudh Creations will not take your artwork and other intellectual property for use on any other site, resell it, or give it to anyone under any circumstance.

Ayudh Creations guarantees that all information that you share with us, including artwork and other intellectual property, contact information, and client notes, will remain confidential.

Ayudh Creations will never contact your clients or the clients of your clients. We respect your business.

Notwithstanding the foregoing, Ayudh Creations may disclose any such information in response to a valid order of a court or other government body or as required by law, but only that portion of the Confidential Information which is legally required to be disclosed, or such information as may be required to resolve any dispute between you and Ayudh Creations.

When a project begins, all our clients become beneficiaries of one of the 2 types of rights to their project results.

6.1. STANDARD IMAGE RIGHTS

All Ayudh Creations clients automatically have these kinds of rights. Therefore, we retain the right to utilise project photos for marketing and promotional initiatives. We may use them for a variety of things, including but not restricted to blog entries, portfolio pieces, pricing lists, booklets, social media ads, printed and online catalogues, and postings on other platforms.

It’s important to note, however, that this applies to project results only. We do not disclose any files or documents sent by the client, i.e., AI Artworks, CAD data.

6.2. EXCLUSIVE IMAGE RIGHTS

You can upgrade to Exclusive Image Rights if you would like the project's output to be your sole property. In that situation, we renounce all claims to the project's visual materials.
